These Terms of Use constitute a legal agreement between you and the Royal College of Physicians and Surgeons of Canada (“Royal College”) in respect of your use of this website, our products and services, and access to third-party platforms available through the website (collectively, the “Site”). It states the terms and conditions under which you may access and use the Site and all written and other materials displayed or made available through the Site, including, without limitation, articles, text, graphics, images, illustrations, recordings, publications, computer software and code (collectively, the Site “Content”). By using the Site, you indicate your acceptance of these Terms of Use. If you do not accept these Terms of Use, you should not use this Site or its Content.

Note: In these Terms of Use, all references to the Royal College include its affiliates Royal College Canada International and the Royal College Foundation.

The Royal College may revise and update these Terms of Use at any time without prior notice, and changes are effective immediately upon posting. It is your responsibility to review these Terms of Use on a regular basis for any changes. Your continued use of the Site means you accept these changes.

This Site does NOT provide medical advice. All Content found on the Site is provided for information and education purposes only. The Site provides information on a wide range of health and medical education topics. Ideas and approaches contained within such learning materials do not represent the standard of care for Canadian health-care professionals. You may not access parts of the Site to which you are not authorized. Certain sections or features of the Site are password-protected and require you to login. Your user ID and password are for your personal use only. You are responsible for maintaining the confidentiality of your user ID and password and are responsible for all activities that occur under your account.

You agree to notify the Royal College immediately of any unauthorized use of your user ID or password or any other breach of security. The Royal College will not be liable for any loss or damage arising from your failure to protect your user ID or password.

You agree that, by accessing areas using your user ID and password, the Royal College may use your user ID and password as the means to authenticate your identity for the purposes of using restricted areas on the Site.

When making changes to your information though the Site, you agree that you will only provide information that is true, accurate, current and complete. If the Royal College has grounds to suspect that such information is untrue, inaccurate, not current or incomplete, the Royal College has the right to refuse to process any transaction or end your access to the Site. The Royal College will not be responsible to you in any manner if any amendment made to your account information is not true, accurate, current and complete.

You are solely responsible for the content of your submissions to the Site. You shall not upload to, or distribute or otherwise publish to the Site, any libelous, defamatory, obscene, pornographic, abusive, or otherwise illegal material.

You agree that you will not threaten or verbally abuse other users or administrators of the Site, use defamatory language, or deliberately disrupt discussions with repetitive messages, meaningless messages or "spam."

You agree not to use language that abuses or discriminates on the basis of race, religion, nationality, gender, sexual preference, age, region, disability, etc. Hate speech of any kind is grounds for immediate and permanent suspension of access to all or part of the Site.

The purchase or license of goods and services from the Site are subject to the Terms of Use and the following provisions:

All prices are in Canadian dollars and are subject to tax, handling charges and shipping charges may apply.
The Royal College reserves the right to make any necessary updates, changes and adjustments at any time without prior notice to product descriptions, warranties and prices due to errors, product discontinuation, changing costs, new market conditions or any other business factor.
Prices for back-ordered items cannot be guaranteed.
Orders being shipped outside of Canada may be subject to additional taxes, shipping charges, customs and duties, all paid and provided for solely by you.

Restricted content and applicable law

The Royal College’s headquarters are located in Ottawa, Ontario, Canada. The Royal College makes no claims that its Site or Content is appropriate or may be downloaded outside of Canada. Access to the Content may not be legal for certain individuals or in certain countries. If you access the Site from outside Canada, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

The Site can be accessed from all provinces and territories of Canada, as well as from other countries around the world. As each of these jurisdictions has laws that may differ from those of the Province of Ontario, all matters relating to access to, or use of, the Site or any website linked to the Site, shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein.

The Royal College reserves the right at any time to change or stop, temporarily or permanently, its Site (or any part thereof) without written notice. The Royal College may, in its sole discretion, terminate or suspend your right to use the Site, or any part of the Site, at any time without notice. In the event of such termination, or suspension, you are no longer authorized to access, view or use the Site, or the part of the Site affected by such termination or suspension. The restrictions imposed on you with respect to material downloaded from the Site, the disclaimers and the limitation of liability set forth in this Agreement, shall survive termination or suspension of this Agreement for any cause. The Royal College will not be liable to you or any third-party for any changes, suspension, termination or discontinuance of its Site.

Limitation of Liability

In no circumstances is the Royal College or its affiliate, or their respective officers, Council members or directors, employees or volunteers responsible or liable for any loss or damages whatsoever, including (without limiting the generality of the foregoing) any direct, special, indirect, punitive, incidental or consequential damages incurred in connection with your use, misuse or reliance upon the Site or Content, your inability to use the Site, or from the purchase, licensing, use or performance of any products or services made available on this Site. This is regardless of the cause and whether arising in contract (including fundamental breach), tort (including negligence), or otherwise. The foregoing limitation will apply even if the Royal College knew of or ought to have known of the possibility of such damages. This disclaimer applies to any damages or injury caused by any failure of performance, error, omission, interruption, delay in operation or transmission, communication line failure, theft or destruction or unauthorized access to, or alteration of, information on this Site.

Without limiting the generality of the foregoing, the Royal College is not responsible for any Content or information that you may find undesirable or objectionable on the Site.

The Royal College is not responsible and assumes no liability for third-party content found on the Site or third-party information provided through the Site.

The English version of these Terms of Use is the official version, should there be any discrepancy between English and French versions.
